UK Supreme Court Judgment: Update on practical implications for staff, students and members of the public

At Loughborough we recognise that the recent UK Supreme Court ruling, that in the Equality Act 2010 ‘sex’ means biological sex, will be having a significant impact.

We will be guided by our institutional values including authenticity – what this means in practice is we aim to be honest, open and respectful.  

The implications for members of our university community have already included feeling uncertain about which toilet facilities can be accessed, concerns about potential changes to how some members of our community will now be perceived, and potential threats to personal safety.  

At Loughborough, our aim is to ensure that we manage our response to this ruling with utmost care and sensitivity and ask that we continue to treat each other with dignity and respect. The rights of trans and non-binary people continue to be protected, and the University must be a safe and inclusive environment in which to work and study for all. 

As a workplace and provider of services to the public, Loughborough has a duty to act consistently with this ruling. However, while the ruling restates definitions of binary sex in clear terms it raises, so far, unanswered questions about how it can be practically and respectfully applied. The Equality and Human Rights Commission (EHRC) have produced some interim guidance however, this is subject to possible change, pending an updated Code of Practice (to be received by the government in June /July 2025).  

We will therefore issue further communications as and when more conclusive guidance and advice is provided, and we will ensure opportunities for consultation and feedback about how any changes are implemented in our university community. 

Current guidance for staff and students of Loughborough University 

  • Continue to use toilet / washing/ changing facilities on both Loughborough and London campuses as you did before. 
  • We continue to follow our principles for inclusiveness in sport, as agreed in 2022. 
  • Continue to treat other members of the University community with dignity and respect, in all environments.
